Terms of Service

Last updated and effective

UnrealPhotos.io is operated by Digital Corner ApS (CVR DK42289159), a company registered in Denmark ("UnrealPhotos", "we", "us"). By creating an account, making a purchase, or otherwise using our website, applications, or related services (the "Service"), you agree to these Terms of Service (the "Terms") and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You may only use the Service if all of the following are true:

  • You are at least 18 years old, or the age of majority in your jurisdiction if that is higher.
  • Your use is legal where you are. You are responsible for making sure your use of the Service complies with all laws that apply to you. We make no representation that the Service is appropriate or available in every location.
  • You are not a politically exposed person (PEP), meaning you do not currently hold, and have not held, a prominent public position.
  • You have not previously been suspended or banned from the Service.

We do not require formal identity verification for general use, but we may request it, or suspend access, if we reasonably suspect a violation of these Terms. Failure to meet any eligibility condition may result in immediate suspension or termination without refund.

2. Your account

You are responsible for everything that happens under your account, for keeping your login credentials confidential, and for keeping your contact details accurate. Accounts are personal and may not be shared, sold, or transferred. Tell us immediately at support@unrealphotos.io if you believe your account has been accessed without permission.

3. What the Service does

The Service uses artificial intelligence to generate images based on photos you upload and instructions you give. AI output is inherently variable. We do not promise that any generated image will look a particular way, resemble you or any other person to any particular degree, be free of artifacts, be suitable for any particular purpose, or pass any third-party review, filter, or detection system. Credits are consumed by the act of generating, not by whether you like the result.

We are continuously changing the models, features, and workflows behind the Service. Features may be added, changed, limited, or removed at any time.

4. Your responsibilities and prohibited uses

Consent and likeness

You may only upload photos of yourself, or of other people who have given you their explicit consent to have their likeness used with the Service. You are solely responsible for obtaining and keeping proof of that consent. We do not verify consent and accept no liability for content created without it.

Minors

You must never upload, create, request, or share any content depicting or involving anyone under 18. Any violation results in immediate termination, reporting to the relevant authorities, and any legal action we consider appropriate.

Prohibited content and conduct

You agree not to use the Service to create, upload, request, or distribute content that:

  • is pornographic, sexually explicit, sexually suggestive, or otherwise adult in nature;
  • is violent, hateful, discriminatory, harassing, threatening, defamatory, or abusive;
  • spreads misinformation, propaganda, or deceptive narratives, or is intended to manipulate individuals, groups, or societies;
  • is a "deepfake" or otherwise impersonates, misrepresents, or falsely portrays a real person, organisation, or event, or could reasonably be mistaken for another person or falsely suggest their identity, affiliation, or endorsement;
  • constitutes or supports fraud, scams, identity theft, falsified documents, fake credentials, or any other illegal activity;
  • infringes anyone's copyright, trademark, privacy, publicity, or other rights.

You also agree not to attempt to hack, probe, circumvent, or disrupt the Service or its security; not to scrape, use bots or automation, or place excessive load on our infrastructure; not to reverse engineer or resell the Service; and not to use any generated content in a way that violates the rules of the platform on which you use it.

Your use of generated images

You alone decide where and how to use images you generate. You are responsible for complying with any laws or platform rules that apply to that use, including any obligation to disclose that an image is AI-generated or AI-edited. We provide no advice on, and accept no responsibility for, your use of images on any third-party platform.

Violation of this section may result in immediate suspension or termination without notice or refund, forfeiture of any credits, and reporting to law enforcement.

5. Content ownership and licence

Your content

Photos you upload and images you generate ("Your Content") remain yours. Subject to these Terms, you own the rights in Your Content and may use it for any lawful purpose.

Licence to us

You grant us a worldwide, non-exclusive, royalty-free licence to store, process, reproduce, and adapt Your Content as needed to operate, secure, support, and improve the Service, including training or fine-tuning a model on the photos you upload for the purpose of generating images for you. We will not use Your Content in external marketing without your prior consent.

Privacy of your content

Your Content is private by default. We do not publish or distribute it unless you choose to share it yourself, or we are required to by law. Sharing Your Content externally is entirely your decision and responsibility.

Our intellectual property

The Service, including its software, models, prompts, templates, designs, trademarks, and other materials, belongs to us or our licensors. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our written permission.

Our right, not obligation, to review

We may, but are not obliged to, review content for compliance with these Terms and the law, and may remove content or suspend accounts at our discretion.

6. Plans, credits, and payments

What we sell

We offer recurring subscriptions billed at the interval shown at checkout (for example monthly or yearly), one-time credit packs, and occasionally other offers. The plan name, price, billing interval, and number of credits that apply to your purchase are the ones displayed at checkout and in your account at the time you buy. We may change plans, prices, and credit allowances for future purchases at any time; changes to the price of an existing subscription take effect only after we notify you.

Credits

Generating images consumes credits. The credit cost per image varies by feature and may change.

  • Subscription credits are granted for each billing period. On each renewal your balance is reset to the plan allowance. Unused subscription credits do not roll over, accumulate, or stack from one period to the next.
  • When a subscription ends, whether by cancellation, expiry, non-payment, pause, or termination, any remaining subscription credits are forfeited immediately. You will not be able to generate further images unless you buy credits separately or resubscribe.
  • Credit-pack credits are a one-time purchase, do not require a subscription, and do not expire while your account remains open. Subscription credits are consumed before credit-pack credits.
  • Legacy "lifetime" and "unlimited" plans sold in the past grant a fixed number of credits per month, subject to this section and to the fair-use policy below. "Lifetime" refers to the operational lifetime of the Service, not your own.

Credits have no cash value. They cannot be exchanged for money, transferred between accounts, sold, or refunded, except as set out in the refund section below. If a generation fails for technical reasons we may, at our discretion, return the credits it consumed. Credits are not returned for results you simply dislike.

Billing and renewal

Subscriptions renew automatically at the end of each billing period, for the same interval and at the then-current price for your plan, until you cancel. By subscribing you authorise us and our payment processor to charge your payment method on each renewal. If a payment fails, we may retry it, and we may suspend or downgrade your account until it succeeds.

Cancellation

You may cancel at any time from your account page. Cancellation stops future renewals. Your subscription, including its remaining credits, stays active until the end of the period you have already paid for, after which the credit-forfeiture rules above apply. We do not refund the remainder of a billing period after cancellation.

Taxes

Prices exclude VAT and other taxes unless stated otherwise at checkout. Where we are required to collect tax we will add it at checkout; otherwise you are responsible for any taxes that apply to your purchase.

Promotions

Discounts, promotional codes, save offers, and other promotions are valid only for the period and conditions stated, cannot be combined unless we say otherwise, may be limited to one per customer, and may be withdrawn or changed at any time.

Chargebacks

If you dispute a charge with your bank or card issuer rather than contacting us first, we may immediately suspend your account and forfeit any credits pending resolution. We will provide our payment processor with evidence of your use of the Service.

7. Refunds

All purchases are final. Because credits are delivered immediately and consumed on generation, we do not offer refunds for unused credits, unused subscription time, dissatisfaction with results, or failure to cancel before a renewal, except where required by law.

Right of withdrawal (EU/EEA and UK consumers). If you are a consumer in the EU, EEA, or UK you may have a 14-day right to withdraw from a distance purchase. By purchasing, you expressly request that we begin delivering the Service, including credits, immediately, and acknowledge that you lose your right of withdrawal once delivery has begun, and in particular once you have generated any image. If you have not used any part of your purchase, contact support@unrealphotos.io within 14 days of purchase to withdraw.

We may, at our sole discretion, issue a full or partial refund as a goodwill gesture. Doing so does not create a right to refunds in other cases. We may refuse refunds where we detect abuse, including repeated purchases and refunds, or use of multiple accounts.

8. Fair use

All plans, including any legacy lifetime or unlimited plan, are subject to fair use. Use that in our reasonable judgement is excessive, automated, non-human, or inconsistent with normal individual use may result in throttling, temporary pausing, or limiting of generation. A pause under this policy is temporary and does not delete your content. Enforcement of this policy does not entitle you to a refund, compensation, or extension.

9. Service availability and changes

We aim to keep the Service running reliably, but it is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, timely, secure, or error-free, or that any feature, model, or template will continue to be available. We may modify, suspend, limit, or discontinue any part of the Service, or the Service as a whole, at any time. If we discontinue the Service entirely, we will make reasonable efforts to give notice, but we do not owe refunds or compensation for discontinuation, including for legacy lifetime plans, except where required by law.

10. Suspension and termination

We may suspend or terminate your account at any time, with or without notice, if we believe you have breached these Terms, if required by law, to protect the Service or other users, or if the Service is discontinued. On termination for breach you forfeit all credits and any right to a refund. You may close your account at any time by contacting support@unrealphotos.io; closing your account cancels any active subscription immediately, forfeits unused time and credits, and permanently deletes your content.

11. Disclaimer of warranties

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will meet your requirements, that results will be accurate, realistic, or of any particular quality, or that generated images will be accepted by any third party.

12. Limitation of liability

To the fullest extent permitted by law, UnrealPhotos and its owners, directors, employees, contractors, suppliers, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to the Service or these Terms, however caused and under any theory of liability, even if advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to the Service or these Terms is limited to the amount you paid us in the three (3) months immediately before the event giving rise to the claim, or USD 50, whichever is lower.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including mandatory consumer protection rights.

13. Indemnification

You agree to indemnify, defend, and hold harmless UnrealPhotos and its owners, directors, employees, contractors, suppliers, and affiliates from any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to Your Content, your use of the Service or of any generated image, your breach of these Terms, or your violation of any law or of any third party's rights.

14. Affiliate and referral programmes

Our affiliate and referral programmes are governed by their own terms, which apply in addition to these Terms.

15. Disputes and governing law

These Terms are governed by the laws of Denmark, without regard to its conflict-of-law rules. Any dispute arising from or relating to these Terms or the Service shall be brought exclusively before the City Court of Aarhus (Retten i Aarhus), Denmark, and you submit to the jurisdiction of that court. If you are a consumer, mandatory rules of the country in which you live may also apply and give you the right to bring proceedings there.

To the extent permitted by law, you agree that any claim will be brought individually and not as part of any class, collective, or representative proceeding, and that any claim must be filed within one (1) year after it arose.

16. General

These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. We may assign these Terms; you may not. We are not liable for any failure caused by events outside our reasonable control.

17. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page and, for significant changes, may notify you by email or in the app. Your continued use of the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service and close your account.
